General terms of use.
These terms govern access to and use of the MediaBay.fr service. By using the converter, you accept them in full.
Purpose and acceptance.
These general terms of use (the “Terms”) govern access to and use of the MediaBay.fr website (the “Service”), published by Markovic Technologies, a sole proprietor.
Using the Service implies full and unreserved acceptance of these Terms. If you do not accept all or part of these terms, you must immediately stop using the Service.
Description of the Service.
MediaBay is a free image conversion and compression tool (JPG, PNG, WebP, GIF, BMP, HEIC, AVIF). Its fundamental feature is that all processing runs locally, in the user's browser, using WebAssembly technology. No file is sent to the publisher's servers.
The Service is available free of charge and without registration. It is funded through the display of advertising (see the “Advertising” section).
Rules of use.
The user agrees to use the Service in compliance with the law and these Terms. In particular, the user shall not:
- process unlawful or infringing content, or content that violates the rights of third parties;
- attempt to misuse, overload, disrupt or compromise the proper functioning of the Service or its infrastructure;
- use automated means (bots, scripts) likely to harm the Service or distort its use.
The user remains solely responsible for the files they process using the Service, as well as for the compliance of their use with applicable law.
Limitation of liability.
Liability related to local processing
Because all processing of your images takes place directly in your device's CPU and RAM via WebAssembly, MediaBay disclaims all liability in the event of slowdowns, memory saturation or unexpected crashes of your browser.
The Service is provided “as is” and “as available”, without warranty of any kind, express or implied. Due to the client-side architecture described above, Markovic Technologies expressly disclaims all liability, in particular in the event of:
- crash, freezing or unexpected closing of the browser of the user;
- saturation of the RAM or processor overload when processing large files;
- slowness of execution or processing time deemed unsatisfactory;
- loss of local data or of files not saved by the user;
- conversion result not matching expectations (quality, compression ratio, compatibility);
- incompatibility with a given browser, operating system or device.
It is the user's responsibility to keep a backup copy of their original files before any operation. Markovic Technologies cannot be held liable for any damage, direct or indirect, resulting from the use of or inability to use the Service.
Availability of the Service.
Markovic Technologies strives to ensure the availability of the Service, without however guaranteeing its continuity. The Service may be interrupted, suspended or modified at any time, in particular for maintenance reasons, without notice or compensation.
Advertising.
As the Service is free, its funding relies on the display of advertising banners (Adsterra ad network). By using the Service, the user acknowledges and accepts the presence of these adverts. The terms relating to advertising cookies are described in the privacy policy.
Intellectual property.
The Service, its source code, its design and its content are protected by intellectual property law and remain the exclusive property of Markovic Technologies. The terms are detailed in the legal notice.
The user, for their part, retains all rights to the files they process — these never leaving their device.
Personal data.
The processing of personal data is described in the privacy policy, in accordance with the GDPR.
Changes to the Terms.
Markovic Technologies reserves the right to modify these Terms at any time. The applicable version is the one in force on the date the Service is used. The date of the latest update appears at the top of the document.
Governing law and disputes.
These Terms are governed by French law. In the event of a dispute, the user is invited to first seek an amicable solution by writing to contact@markovictechnologies.com. Failing an agreement, jurisdiction is granted to the competent French courts, subject to the protective legal provisions applicable to consumers.
